The Legal Key to Buying Land When You Can’t Be There

Picture a Pakistani living in Dubai who finds the perfect farmland back home, or a family elder too unwell to travel to the Sub-Registrar’s office for a sale. In both cases, the deal does not have to stall. A Power of Attorney (PoA) lets you legally appoint a trusted person to act on your behalf, to sign, submit, register, and complete a land transaction while you are somewhere else entirely.

For overseas Pakistanis especially, the PoA is the single most important legal instrument in any property purchase. It is also one of the most misused, poorly drafted or overly broad powers of attorney are behind a large share of Pakistan’s land fraud cases. Used correctly, a PoA is safe, simple, and powerful. Used carelessly, it can hand away your land.

What Is a Power of Attorney? The Basics

A Power of Attorney (PoA) is a written legal document in which one person (the Principal, or donor) authorises another person (the Attorney, agent, or attorney-in-fact) to act on their behalf. In Urdu, it is commonly called a Mukhtar Nama. The person given the authority is the Mukhtar.

Legal Framework in Pakistan

ACT OF 1882

The Powers-of-Attorney Act, 1882

Provides the statutory framework for acts performed under a Power of Attorney and their legal effect.

ACT OF 1908

The Registration Act, 1908

Sets rules for registration of documents and recognition of attorneys for registration purposes. Applicable formalities depend on the transaction and the nature of the authority.

A Crucial Point Most People Miss

A Power of Attorney authorises someone to act. It is NOT itself a transfer of ownership.A PoA does not make the agent the owner of the land. Ownership must be transferred through the legally required property-transfer process, including a registered conveyance where applicable and corresponding updates to the land record (inteqaal).

Do not treat a PoA as a substitute for a legally valid property sale. Always verify ownership and the required transfer documentation before paying for land.

Types of Power of Attorney in Pakistan

Choosing the right type is the most important decision you will make. There are three you should know:

Types of Power of Attorney in Pakistan

TypeScope of AuthorityBest Used ForRisk Level
General PoA
(Mukhtar Nama Aam)
Broad authority over many matters or all affairs relating to a property Trusted family handling multiple ongoing matters HIGH — avoid for one-off sales
Special PoA
(Mukhtar Nama Khas)
Limited to one specific act or transaction only Selling, buying or registering one specific plot LOW — recommended for property
Sub-PoA An attorney delegating granted powers onward to a third person Only when the original PoA expressly allows it HIGH — use with caution

The distinction between General and Special is not a technicality, it decides how much of your wealth is exposed if something goes wrong.

Why a Special PoA Is Safer Than a General PoA for Property

A General Power of Attorney (Mukhtar Nama Aam) gives your agent broad, sweeping authority, potentially the power to sell, mortgage, gift, or otherwise dispose of your property as they see fit. Experienced investors almost never use a general PoA for a single property deal, because it hands the agent far more power than the task requires.

A Special Power of Attorney (Mukhtar Nama Khas) is tied to one specific transaction, for example, “to complete the purchase and registration of Plot/Farmland No. X in Mauza Tarap, Talagang.” Once that act is done, the power is exhausted. This is the recommended route for buying or selling a single piece of land.

Best Practice

A well-drafted Special PoA names the exact property, lists the exact powers granted, and includes an express clause stating that the attorney has NO power to sell, gift, or transfer the property to himself/herself or to anyone else beyond the stated purpose. This clause helps protect against a common form of PoA fraud.

How to Execute a Power of Attorney Within Pakistan

If you are a resident principal inside Pakistan, the process generally involves the following steps:

01
Step One

Draft the PoA

Prepare the document clearly stating the principal, the attorney, the specific property, and the exact powers granted. A property lawyer should draft or review it.

02
Step Two

Print on Stamp Paper

Execute the document on the appropriate stamp paper with the required stamp duty. Confirm the current value and requirements for your province and transaction.

03
Step Three

Add Witnesses and Photographs

Arrange the required witnesses and identity documents, including relevant CNIC copies and photographs of the principal and attorney, as applicable.

04
Step Four

Attest Before a Notary Public

Where notarisation is required, have the document and signatures verified by an authorised Notary Public. Notarisation alone may not satisfy registration requirements.

05
Step Five

Register at the Sub-Registrar

For property transactions requiring a registered PoA, complete registration before the relevant Sub-Registrar. Identity and biometric verification may apply under local procedures.

Important Notice

A notarised Power of Attorney is not necessarily sufficient for a land transaction. Depending on the powers granted and applicable law, formal registration or other authentication may be required. Confirm the requirements with the relevant Sub-Registrar and a qualified property lawyer before proceeding.

Route A: Traditional Embassy Attestation

  1. Draft the PoA in favour of your trusted attorney in Pakistan.
  2. Appear in person at the Pakistani Embassy/Consulate in your country of residence, where a Consular Officer attests your signature. All executants must appear in person.
  3. Counter-verification by the Ministry of Foreign Affairs (MOFA) in Pakistan once the document reaches the country.
  4. Registration at the Sub-Registrar in the district where the land is located.

Time-Sensitive

Attestation from the embassy may have a limited validity period, commonly six months depending on the applicable procedure. Complete the required formalities in Pakistan within the relevant period to avoid possible expiry, rejection, or repeat attestation.

Route B: NADRA Digital Power of Attorney (The Modern Way)

Launched in November 2021, the NADRA Digital PoA developed by NADRA with the Ministry of Foreign Affairs, lets overseas Pakistanis grant a Power of Attorney entirely online, without visiting the embassy. Apply through the official portal: poa.nadra.gov.pk.

The digital process works like this:

  1. Create an account on the PoA portal using your email, and authenticate via OTP.
  2. Enter details of the executor (you), the attorney, and the witnesses.
  3. Upload documents: the scanned Power of Attorney, your valid NICOP/CNIC/POC, the attorney’s ID, and any affidavit required.
  4. Biometric verification via the downloadable fingerprint forms.
  5. Pay the fee online by credit/debit card (indicatively around US$36, varying by number of executors and country).
  6. Online video interview with a consular officer, followed by your final consent by email.
  7. Receive and dispatch: after approval, print the digital receipt and courier it with the original PoA to your attorney in Pakistan.

Both systems run in parallel, so you can pick the digital route for speed or the manual route if you prefer. Here is how they compare:

Factor Manual (Embassy Attested) NADRA Digital PoA
Embassy Visit Required - principal generally appears in person at the Pakistani Mission. No physical embassy visit for eligible applicants. Complete the application remotely.
Process Embassy attestation, applicable MOFA verification and required property registration formalities. Online application, document upload, biometrics, fee payment, video interview and final approval.
Biometric Identity and signatures are verified in person. Additional biometric checks may apply. Fingerprint forms uploaded and verified digitally.
Indicative Fee Per-document attestation fee, varying by country and mission. Around US$36 in some published mission guidance. Confirm the current portal fee before applying.
Speed May take longer because of appointments, travel, courier delivery and manual processing. Avoids embassy travel. Processing time depends on verification and interview availability.
Still Need Original document, applicable MOFA verification and registration where required in Pakistan. Approved document or receipt sent to the attorney in Pakistan, with any additional verification or registration required for use.

Documents & Fees: What to Budget For

Exact charges vary by province, district, and property value, so treat the following as indicative and confirm current rates with the Sub-Registrar or your lawyer:

  • Stamp paper: roughly PKR 500–PKR 5,000 for the PoA instrument, depending on province and purpose
  • Notary/attestation fee: a nominal charge for the Notary Public
  • Sub-Registrar registration fee: varies by province and district; confirm the current schedule locally
  • Embassy attestation (overseas, manual): a per-document fee that varies by country
  • NADRA Digital PoA: around US$36, varying by number of executors

Documents typically required: the drafted PoA, CNIC/NICOP of the principal and attorney, passport-size photographs, details and ID of two witnesses, and the application form.

Red Flags & Fraud Prevention

Because a PoA transfers control, it is a favourite tool of fraudsters. Guard against these:

Common PoA Frauds

01

General PoA Misuse

An agent given broad powers sells or mortgages land the principal never intended to part with.

✓

Prevention: Use a carefully drafted Special PoA with limited powers and an express no-self-transfer clause.

02

Forged or Fake PoA

A fabricated or altered Power of Attorney is used to transfer land belonging to someone else.

✓

Prevention: Verify the document through the relevant registration authority, check identity records and complete applicable biometric verification.

03

PoA Used After Principal's Death

Someone attempts to use a PoA after the principal has died, even though ordinary agency authority generally ends upon death, subject to legal exceptions.

✓

Prevention: Confirm the principal's current status and have the legal validity of the attorney's authority checked before proceeding.

04

Notarised-Only PoA

A notarised Power of Attorney is presented as sufficient authority for a land transaction without meeting applicable authentication or registration requirements.

✓

Prevention: Confirm the required authentication and registration with the relevant Sub-Registrar before relying on the document.

Because a PoA transfers control, it is a favourite tool of fraudsters. Guard against these:

When Does a Power of Attorney Become Invalid?

A PoA does not last forever. It ends automatically in any of these situations:

  • Revocation: the principal cancels it (see below)
  • Death of the principal: the authority dies with them
  • Mental incapacity of the principal: if the principal becomes legally incapable
  • Completion of the task: a Special PoA ends once its specific purpose is fulfilled
  • Expiry of term: if the PoA states a fixed validity period that has passed

How to Revoke a Power of Attorney

A principal can revoke a PoA at any time — whether General or Special. To make the revocation effective and protect yourself:

  1. Execute a written revocation deed clearly cancelling the earlier PoA.
  2. Register the revocation with the same Sub-Registrar where the PoA was registered.
  3. Notify the attorney and all relevant third parties (and, where appropriate, publish a public notice) so no one can continue to rely on the cancelled PoA.

Buying Farmland at Agro Excellence Using a PoA

For overseas and out-of-city buyers, a Special PoA makes owning farmland at Agro Excellence completely practical. You appoint a trusted family member or representative, who completes the purchase steps on the ground while you stay abroad.

  • Appoint a Special PoA: limited to purchasing and registering your specific farmland
  • Verify first: all Agro Excellence farmland is PLRA-verified and computerised inteqaali land, so the title is clean before you commit
  • We facilitate the process: Agro Excellence assists with the inteqaal/mutation steps, so your attorney is not navigating the paperwork alone
  • Pay remotely: combine your PoA with remote payment options, including on flexible installments

It is the same path many overseas Pakistanis use to reclaim and grow ancestral or new farmland without boarding a flight.

Conclusion: Delegate Power, But Keep Control

A Power of Attorney is the bridge between you and your land when you cannot be present, but it must be built carefully. Choose a Special PoA over a General one, name the exact property and powers, add the no-self-transfer clause, register it properly, and revoke it the moment its job is done.

For overseas Pakistanis, the NADRA digital PoA has removed the biggest hurdle, the embassy visit, making it faster than ever to invest back home safely. Pair a well-drafted PoA with proper PLRA verification, and distance stops being a barrier to owning productive farmland in Pakistan.
